Area of application
The following terms and conditions apply exclusively to business transactions between Klaus Dzida and the customer, effective at the time of the transaction. Any deviations from those terms and conditions must be approved in writing by Klaus Dzida.
Contract conclusion and cancellation
All orders must be confirmed in writing by Klaus Dzida.
Barring any other agreement, delivery will be made from stock to the delivery address supplied by the customer.
The customer must pay in advance.
Reservation of proprietary rights
The goods delivered by Klaus Dzida remain the property of Klaus Dzida until full payment and completion of all contracts entered into (including interest and any legal or other expenses). Pledging of such goods or security transfer of title on such goods is not permitted until complete payment has been made and all contractual obligations have been met.
All deliveries are transported at the customer’s own risk. The customer is responsible for reporting and confirming any obvious transport damages upon receipt with the transporter. A receipt or copy of this report must be sent to Klaus Dzida immediately. Unconfirmed obvious damages will not be honored and are not insured. Hidden transport damages or defects must be promptly reported in writing to the transporter as well as any damage claims. Proof of a hidden damage claim must be provided to Klaus Dzida immediately.
Warranty / Guarantee
The 24-month warranty begins on the day of delivery to the customer. The customer is responsible for checking the quantity and quality of the goods promptly. Obvious defects and complaints must be made to Klaus Dzida within 14 days of delivery. The customer does not have the right to withhold payment or cancel the contract as long as Klaus Dzida upholds its responsibility to fix the defect. All products have a 6-month guarantee.
Court of jurisdiction
The court of jurisdiction for all claims and lawsuits in connection with a contract, including summary procedures in which the plaintiff must provide documentary evidence, is Innsbruck.
